Some policies allow the insured to recover indemnity for the work of their employees or PAs in presenting claim. In Tri Town Antlers Foundation,
Inc. v. Fireman’s Fund Insurance Co., 550 N.Y.S. 2d 953, 158 A.D. 2d 908 (1990), the court concluded that PA fees were within coverage provided for extra wages paid to “employees” for preparing inventories and other loss data for completing the proof of loss. The court reasoned that if it was the insurance company’s intent to exclude payment to a PA employed for that reason by the insured it would have been a simple matter to say so.
