Write the Captioned Report – 4

Subrogation

This requires a comment as to why subrogation is or is not involved. An insurer, by reason of its payment to, or on behalf of an insured, gains the equitable right to recover under the remedy of subrogation. If the adjuster has evidence that the wrongful or tortious act of another caused the injury the fact should be reported. If a contractual relationship exists between the insured and the person charged with the responsibility for the insured’s property the insurer may be able to assume the insured’s contractual rights against that party for indemnity. This section of the captioned report requires comment on any and all other rights the insured may have to contractual or implied indemnity.
