Disasters and Limitations of Action and Claims
Disasters bring on interesting, sometimes strange, decisions by trial and appellate courts intent on getting the most money available to insureds regardless of the intent of the drafters of policies of insurance. For that reason an earthquake exclusion may not apply, for instance because the damage was caused by the “tectonic processes of the earth,” or where statutes of limitations are extended by state legislative action.
