Courts Should Not Rewrite Policy
Allowing a so-called innocent spouse to recover when an insurer can prove that an insured attempted or committed fraud makes the public policy to protect an innocent spouse’s property rights more important than the public policy to defeat fraud stated by the California Insurance Frauds Prevention Act or to apply the clear and explicit language of a policy.
