Insurance 101 – Chapter 9 – Volume 32 – Manifestation


Because of the confusion caused by disparate court decisions and a concern to deal fairly with all insureds, insurers in the past liberally construed the continuing loss cases to their own detriment.  Coverage was provided to insureds even if the loss first manifested itself a year after the expiration of a policy or more than a year the loss was reported to the insurer.
