Abuses of the Tort of Bad Faith – 2

Courts are beginning to see that the tool created to stop one abuse has created another abuse: the failure of insurers to resist obviously fraudulent claims because of a fear of exposure to excessive punitive damage awards has caused a logarithmic rise in insurance premiums and a similar rise in claims.
