Punitive Damages

In most jurisdictions, including Texas, California, Arizona, and Florida, punitive damages are recoverable in cases of willful torts such as fraud. In Texas, Arizona, Florida, Georgia, and other jurisdictions, punitive damages are available in cases of gross negligence. The initial Texas tort reform legislation in 1987 limited the amount recoverable to four times the actual damages.
